Terms of Service

Terms of Service must be read and understood before any commission or order is placed.

General Disclaimer;

   Prices listed on the 'Commission Pricing' page are listed for non-commercial use. I retain the original copyright of the image, however, you are granted non-exclusive rights to the image for non-commercial reasons. If commissions are to be used commercially, please discuss this prior to payment agreement as the intent of the art and commission will affect pricing as well. By commissioning me, you agree to these Terms of Service. 

Process of Ordering and Payment Methods;

     When asking about a commission, I will need you to be as concise and clear as possible so I have the best possible idea for your work. Things to include in your description would be the information of your concept, idea, or character, as well as background if it's a subject piece, and any references you may have. If visual references are unavailable, please be as descriptive as possible. 
     From there, I'll provide an estimate or quote for your work and, upon agreement, I will inform you of where you are in my queue. Once I'm up to your order and commission, I will send a request or invoice for a 30% non-refundable deposit that will go towards the final price of your piece and will secure your place in the next project. If payment isn't received in 48 hours or a date of payment wasn't discussed during the estimate stage, then I will return your commission to the end of my queue list and try again up to 3 times. If you're unable to pay after those 4 requests are sent, I will consider the lack of answer as a cancellation and remove the commission from my queue entirely.
     Once the 30% payment is received, I will begin the sketch stage of your work and, upon approval and any changes (see Work In Progress and Corrections for more details), I will then send an invoice for the remaining charges and continue your work and providing updates in the process, once paid. 
     Payments for commissions are all in USD and the following methods are used;
               -Paypal
               -Venmo
               -CashApp
               -Zelle

Work In Progress and Changes;

     Work in progress (WIPs) images and updates will be sent throughout the entire commissioning process. Any major changes like posing correction need to be done in the Sketch Phase of the image, detail additions need to be added in the Lineart Phase and colour changes must be done before the Colouring phase of the pieces. Each outreach will include the question of any changes that you might want to be done, however, once I'm started on the Lineart Phase, I cannot change what's there. If you are dissatisfied, please make sure to speak up during the respective phases so I can make sure the final commission turns out how you'd like. If there are major changes after any of the respecting 'phases' laid out here, there will be additional charges, varying in pricing, as it'll require me to go back to make said changes. 

Final Product Expectations;

     Delivery and finalisation of your commission will be based on the type of commission it is (Digital vs Traditional). 

Digital Commissions; 

     Digital commissions will be emailed to you, 2 files attached. One is a low resolution file that can be shared and reposted online with proper credits, the other is a higher resolution file for personal use only. Please do not alter or 'fix' a detail in the image. I try my best to be as accessible and transparent as possible through the entire process and is seen as a lack of respect for myself, my art, and the work I had put in for the image itself. 

Traditional Commissions;

     Traditional commissions will have a digital file for sharing (depending on size) sent to the email provided with proper crediting as well as the piece itself to display in your home*. There is no additional charge for postage or shipping as that is calculated in the estimate I had quoted you in the beginning. If you live near me, for a lower price, I would be happy to meet somewhere to drop off your painting/picture, as well, to avoid any shipping and handling fees. Please do not edit or 'fix' the image in any way upon delivery. As stated with digital commissions, I try my best to be as accessible and transparent as possible through the entire process and is seen as a lack of respect for myself, my art, and the work I had put in for the image itself.
     *The only exception would be for 'Sponsor-A-Critter' images in which I keep the image and send you a digital file to use and share. 

Refunds;

     Refunds are often discussed on a case by case basis. The 30% deposit to begin your commission is not refundable and is to cover the cost of materials. 
If you request a refund before it enters the Lineart phase, you'll receive 70% of the payment back. 
If a refund is requested before it enters the Colouring phase, you'll receive 40% of the payment back. 
*Once an image has entered the Colouring phase of work, there is no refund issued. Please keep this in mind when making requests.
If more expensive upfront payments are an issue, I would be more than happy to work with you for a payment plan if an image is $75 USD and up. Once the final payment is complete, I will then send you the files and consider the commission completed. 

Artistic Rights and Permissions;

     With the commission, you are granted non-exclusive rights to the image. This means;

               -You may post this on social media to share with proper credit (please link my Facebook, Website, or Instagram page)
               -You may make a print for your own use which may be hung on your wall, put on a coffee mug, made into a phone case, etc
               -You may crop the image to make an icon for yourself.
     I reserve the right to;
 
             -Share the image as-is in both my online and offline galleries (included but not limited to; my Facebook art page, my ArtStation, use in my professional portfolio for jobs and gigs, on my Instagram, etc)
               - Sell prints of your commission piece as-is 
               - Print t-shirts and/or other goods and merchandise with the commissioned piece as-is

I will do my best to communicate my own intentions, however, it is not a requirement on my part.


With the commission, you may not;
               - Sell prints or digital copies of your commission
               - Post the image without due and proper credit
               - Post your commission to be mass-printed by a third-party service (Such as Society6, RedBubble, Displate, etc)

Notes for NFTs, Cryptocurrency, and other blockchain-related inquiries - 

     Nothing made by CyberPsych Artistry, Oliver Hehl/Amanda Hehl may be used in any past, present, or future blockchain-related technology to include NFTs, Cryptocurrency, or future inventions in this space, made INTO NFTs and cryptocurrencies under ANY AND ALL CIRCUMSTANCES. This includes all past, present, and future derivatives, versions, evolutions of these prior mentioned technologies, selling platforms, and/or trading/investing spaces; including but not limited to public and/or private websites, and/or mobile applications. The commercial use of personal, individual use labelled commissioned artwork in any shape or form without the express written permission by CyberPsych Artistry/Oliver Hehl/Amanda Hehl is strictly prohibited. This includes actions performed by means such as a bot or human decision. If it is discovered that anyone uses any past, present, or future artwork created by CyberPsych Artistry/Oliver Hehl/Amanda Hehl (@CPsychArts, @CyberPsych, @CPsychArt) as an NFT or cryptocurrency, legal ramifications will proceed without question which may include but not be limited to;
                - The removal of offending materials from all NFT Marketplaces/Platforms
                - Cover the financial damages as well as earnings from aforementioned purchases, sales, profits, tradings, and interest using a regulated, government recognised currency (USD preferred)
                 - Have their commission removed from CyberPsych Artistry's public art-hosting platforms and services.

Notes regarding Artificial Intelligence (AI) art -

    
Anything created by CyberPsych Artistry, Oliver Hehl/Amanda Hehl is not granted permission to be used in regards to training, teaching, developing and any other variations of coding in Artificial Intelligence (AI) art. The use of art is at the sole discretion of the artist. Any and all sort of inclusion of artwork without express permission of the artist. The ramifications of any sort of violations will also include the same as the previous section (See; Notes for NFTs, Cryptocurrency, and other blockchain-related inquiries).

With the initial estimate and quote, I reserve the right to refuse your commission for any reason. If I happen to turn down your commission concept, it may be because I am not comfortable taking on that job. Some concepts and themes that I will absolutely deny are;
               -Minors in risque or not age-appropriate themes which include but are not limited to sexual poses, situations, and encounters
               -Explicitly sexual for pornography purposes, even if all subjects are adults and consent (I would be happy to provide NSFW images for educational purposes) 
               -Realistic portraiture (this is based on personal taste and experiences. I do not feel I would provide a quality piece based on realism, portraits, or the like)
               -Any sort of hate speech or symbolism
